Chairperson of Pakistan Tehreek-e-Insaf (PTI) Imran Khan says he moved the Islamabad High Court (IHC) against denying his right to defense in the Toshakhana case.

The Toshakhana case refers to Khan’s alleged illegal import of a luxury vehicle in 2010. Khan was the prime minister at the time and was accused of using his position to import the car without paying customs duty.

The National Accountability Bureau (NAB) initially investigated the case, but it was later dropped. However, the case was reopened in 2022 by the PTI’s political opponents.

In April 2023, an additional district and sessions court in Islamabad ordered Khan to appear and explain why he had not submitted a gift declaration for the vehicle. Khan refused to appear before the court and challenged the order in the IHC.

On Wednesday, August 3, 2023, the IHC heard Khan’s petition. Khan’s lawyer, Khawaja Haris, argued that the additional district and sessions court had no jurisdiction to order Khan to appear before the court. He also argued that the order violated Khan’s right to defense.

The IHC bench, comprising Justice Aamer Farooq and Justice Mohsin Akhtar Kayani, reserved its judgment on the petition.

Political observers are closely watching the case. If the IHC rules in Khan’s favor, it could be a significant setback for his political opponents. However, if the IHC rules against Khan, it could further damage his reputation.

The Toshakhana case is just one of several legal challenges facing Khan. He is also facing a disqualification case in the Supreme Court, and the NAB is investigating him on several other issues.

It remains to be seen how Khan will fare in these legal challenges. However, the Toshakhana case is a significant development and could have a major impact on Khan’s political future.
