ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) on Monday moved the Supreme Court, asking it to declare Additional and Sessions Judge (ADSJ) Humayun Dilawar’s verdict in the Toshakhana case “null and void.” The petition, filed under Article 184(2) of the Constitution, seeks to have the Toshakhana case heard again, alleging that PTI chief Mr. Imran Khan was not given a fair trial.
According to the petition, Mr. Imran Khan was arrested and transferred to Attock jail on August 5 after the district and sessions court in the federal capital found him guilty of corrupt practices related to the state gift depository. ADSJ Dilawar sentenced Mr. Khan to three years in jail and imposed a fine of Rs100,000 while also issuing an immediate arrest warrant.
The crux of PTI’s argument lies in the claim that the judgment was passed hastily and in Mr. Khan’s absence, showing complete disregard for the directions of the Islamabad High Court (IHC). PTI alleges that the IHC had previously ordered the issue of maintainability to be reconsidered by the learned Additional Sessions judge, but this directive was ignored, and the application was dismissed hastily without a fair and objective evaluation of the case.
The petition emphasizes that Mr. Imran Khan’s Article 10A guarantees the fundamental right to the Right to a Fair Trial was denied during the proceedings. In addition to approaching the Supreme Court, PTI also filed a petition with the Islamabad High Court, requesting that Mr. Khan be transferred to Adiala jail and provided with better or A-Class facilities.
